Data Collection Vehicles Privacy Notice

Data Collection Vehicles Privacy Notice

At a glance

  • Our vehicles have cameras that record their surroundings so that they can drive safely, be supervised by remote operators, be investigated after an accident and be improved.

  • We keep identifiable video for 30 days. After that it is deleted, or faces and number plates are blurred automatically so that the footage can be used for longer-term analysis and training.

  • If an accident is confirmed, we keep the relevant video for 5 years to handle legal and insurance claims.

  • You can object to the processing and ask for access or erasure. Contact: dataprotection@einride.tech.

1. Who is responsible for your personal data

The Einride company that operates the vehicle that recorded you is the data controller. The list shows which company that is in each country.

The Einride company named on the vehicle or in the list on our website

2. What we collect and where it comes from

Video footage and still images of people and vehicles around the vehicle (road users, pedestrians, drivers, and people on the sites where the vehicle operates). Footage can show faces, clothes and number plates. We collect it with the cameras on the vehicle and, before a vehicle is deployed, with a 360° camera during site surveys. We do not use the footage to identify people. If a vehicle’s equipment also records sound, that is included. You do not have to give us anything; the recording is automatic.

3. Why we use your data, on what basis, and for how long

The table lists every purpose. All of them rely on our legitimate interest, stated in the basis column. Safe operation of autonomous vehicles is a serious interest for road safety, for Einride and for the public.

Develop autonomous capabilities

Advancing autonomous capabilities to enhance vehicle performance and safety in diverse environments. Includes: Algorithm research and implementation; Varied environmental testing; Iterative capability refinement.

Legitimate interest: the processing is necessary for our legitimate interest in developing our autonomous vehicle capabilities to improve safety and performance.

Video

Deleted 30 days after recording; clips kept longer for analysis and training first have faces and number plates blurred automatically

None

Error investigation, analyzing system performance

Analyze system performance and investigate errors in data collection vehicles for optimal functionality. Includes: Error diagnostics and resolution; Performance analysis and enhancement; System optimization for efficiency.

Legitimate interest: the processing is necessary for our legitimate interest in investigating errors and analysing system performance in our autonomous vehicles.

None

Anonymization for extended error analysis and machine learning training

Blurring faces and number plates in recorded video, by an automated tool, before it is used for prolonged error analysis and machine learning training. Includes: Data anonymization for privacy purposes; Extended error analysis capability; Machine learning training enhancement.

Legitimate interest: the processing is necessary for our legitimate interest in blurring faces and number plates in recorded video so that it can be used for extended error analysis and machine-learning training.

Video

30 days while identifiable; afterwards only clips with faces and number plates blurred automatically are kept, up to 2 years

Meet legal requirements to record and keep autonomous-driving event data

Where the law requires, we record a defined set of event data from the vehicle (for example position, when the autonomous function is switched on or off, system status and interventions by the technical supervisor) and keep it so that we can hand it to the authorities on request.

Legal obligation: for example section 1g of the German Road Traffic Act (StVG) requires us to store this data.

Vehicle ID, Position data, Activation and deactivation times, System monitoring data, Technical supervisor interventions (name of the supervisor)

For as long as the law requires, up to 5 years after the event

German Federal Motor Transport Authority (KBA) and other competent authorities, on request

4. How we limit the impact on you

  • Identifiable video is kept at most 30 days, except confirmed accidents (5 years, restricted to the claims, legal and safety team).

  • Longer-term analysis and training use only clips where faces and number plates have been blurred automatically. Access to them is limited, and they are deleted when the period ends.

  • Real-time navigation and remote operation are not stored.

  • Only authorised staff can view footage.

5. Who receives your data

Service providers that work on our behalf (processors) are not named here. They provide cloud hosting and storage, remote operator tools and data analysis tools. They may only use the footage on our instructions. Within the Einride Group, other companies may see the footage to support vehicle operation and development.

Separate controllers (last column of the table): the police and other authorities, insurers and courts, where we must or may share footage, for example after an accident.

6. Transfers outside the EU/EEA

Einride companies in the USA may access the footage. These transfers follow our intra-group data transfer agreement, which includes the EU Commission’s standard contractual clauses. Providers outside the EU/EEA are used only with standard contractual clauses or when they are certified under the EU–US Data Privacy Framework.

7. Automated decisions

We do not use automated decision-making, including profiling, that has legal or similarly significant effects on you.

8. Your rights

  • Access to your personal data, and a copy of it.

  • Correction of data that is wrong or incomplete.

  • Erasure, or restriction of our use, in the cases the law allows.

  • Objection to processing based on our legitimate interest. We then stop unless we have compelling reasons.

  • Data portability for data you gave us and that we process by contract or consent.

  • Tell us when and where you think you were recorded so that we can find the footage.

If you think we handle your data wrongly, you can complain to the data protection authority in your country. In Sweden this is the Swedish Authority for Privacy Protection (IMY, imy.se).
