Driver Privacy Notice

Driver Privacy Notice

At a glance

  • This notice is for drivers who work for Einride through a staffing agency or a carrier and do NOT use Saga. If you use the Saga app or portal, read the Saga Privacy Notice instead (both apply if you use both).

  • Your employer is responsible for your employment and pay data. Einride is responsible for the data we use to plan and run the transports you drive.

  • We use your name and contact details, driver ID and driver card, hours, vehicle, trip and position data and tachograph data to run the transports and to meet road-transport rules.

  • We delete planning, trip and position data 12 months after the job. Tachograph and working-time records are kept as the law requires, at most 2 years.

  • You can ask for access, correction or erasure and object to processing based on our legitimate interest. Contact: dataprotection@einride.tech.

1. Who is responsible for your personal data

Your staffing agency or carrier is the data controller for your employment, pay and personnel data. The Einride company that directs your work is a separate data controller for the data described here. We do not decide how your employer uses your data, and your employer does not decide how we use ours. The Einride company is:

Sweden

Einride AB

Norway

Einride Technologies Norway AS

Netherlands

Einride Technologies Netherlands B.V.

Belgium

Einride Technologies Belgium B.V.

Germany

Einride Technologies Germany GmbH

Austria

This notice does not apply to people who use Saga; they should read the Saga Privacy Notice. If you use both Saga and the on-board computer, both notices apply to you.

2. What we collect and where it comes from

  • From your employer: your name, contact details, driving licence and qualifications, and the hours you work.

  • From you and from the vehicle: your driver ID and driver card, vehicle and trip data, position, tachograph data (driving and rest times), and messages and status updates in the on-board computer and our transport planning system. We check your identity when you start.

Your employer gives us the data we need to use you for the work. If you do not give us the data we need to run the transport and meet the law, we cannot let you drive for us.

3. Why we use your data, on what basis, and for how long

The table lists every purpose. Where we rely on legitimate interest, the interest is stated in the basis column.

What we do

Legal basis

Personal data

Kept for

Separate controllers (recipients)

Plan and run our own transports

Plan, dispatch and carry out the transports that Einride runs itself with its own drivers and drivers supplied by staffing agencies, and follow up the work.

Legitimate interest: to plan and run our transports efficiently and safely

Name, Phone number, Driver ID, Vehicle and trip data, Position data, Hours worked, Telematics data

Deleted 12 months after the job; hours records follow the road-transport rules

Staffing agency that employs the driver (hours worked)

Meet road-transport rules (driving and rest times, working time, licences)

Meet the legal duties of a transport operator for drivers: download and keep tachograph data, keep working-time records and check driving licences and professional qualifications.

Legal obligation: road-transport and working-time law

Name, Driver card number, Tachograph data (driving, rest, vehicle), Working hours, Driving licence and qualification details

Deleted 2 years after the recording (tachograph copies must be kept at least 12 months; working-time records 2 years)

Road-transport inspection authorities (e.g. Transportstyrelsen, Polisen, ILT)

4. Who receives your data

Service providers that work on our behalf (processors) are not named here. They provide the on-board computer, tachograph handling, transport planning and cloud tools. They may only use your data on our instructions.

Separate controllers (last column of the table): your staffing agency or carrier (hours worked), and road-transport inspection authorities and the police, where the law requires. For some customers we are joint controllers for the telematics data of the vehicles; in that case we give you the information that customer requires.

5. Customer sites and loading places

At a customer’s site (for example a warehouse where you load or unload), the customer or the site operator may also process some of your personal data, such as entry registration and delivery receipts. They do this as a separate controller under their own privacy notice. For information about that processing, contact the customer site where you work, or contact us at dataprotection@einride.tech and we will help you.

6. Transfers outside the EU/EEA

Einride companies in the USA and the UAE may access some data to support the service. These transfers follow our intra-group data transfer agreement, which includes the EU Commission’s standard contractual clauses. Providers outside the EU/EEA are used only with standard contractual clauses or when they are certified under the EU–US Data Privacy Framework.

7. Automated decisions

We do not use automated decision-making, including profiling, that has legal or similarly significant effects on you.

8. Your rights

  • Access to your personal data, and a copy of it.

  • Correction of data that is wrong or incomplete.

  • Erasure, or restriction of our use, in the cases the law allows.

  • Objection to processing based on our legitimate interest. We then stop unless we have compelling reasons.

  • Data portability for data you gave us and that we process by contract or consent.

  • Your employer remains your first contact for questions about your employment and pay.

If you think we handle your data wrongly, you can complain to the data protection authority in your country. In Sweden this is the Swedish Authority for Privacy Protection (IMY, imy.se).
