1. Introduction: Your Data, Your Rights under the EU Data Act

The EU Data Act (Regulation (EU) 2023/2854) establishes harmonised rules on fair access to and use of data. It empowers users of connected products and related services to access the data they help generate. This page is designed to provide you with clear and comprehensive information about the data generated through your partnership with Einride, in accordance with our transparency obligations under Article 3 of the Data Act.

6. Protected Data

In accordance with the Data Act (Recital 15), data that is the output of Einride's proprietary algorithms and represents new knowledge created through our investment is considered Inferred or Derived Data. This is Einride's core intellectual property and is not subject to the user's right of access. Examples include an optimized route plan, a calculated ETA, or a 'Network Efficiency Score' benchmark.

7. Our Use of Data

Einride, as a data holder, uses the non-personal data described above for the following legitimate purposes:

  • To Provide and Optimise our Services: To execute transport services, provide functionality within the Einride Saga Platform, offer support, and ensure the operational performance of our solutions.

  • For Product and Service Development (R&D): To analyse aggregated data for the purpose of improving the efficiency, safety, and functionality of our vehicles and the Saga Platform.

  • For Safety, Quality, and Proactive Maintenance: To monitor the health of our fleet, identify potential safety issues, investigate incidents, and manage warranty and quality surveillance.

  • For AI and Algorithm Training: To develop, train, and validate algorithms related to logistics optimisation, predictive maintenance, energy consumption modelling, and autonomous technologies.

8. How to Access Your Data

As a user, you have the right to access your data. Please follow this process:

  1. Send a formal request to our dedicated email address: data.act@einride.tech. Please specify your company name, the relevant vehicle(s) or service, and the desired time period for the data.

  2. Einride will verify your identity and your legal right as a "user" under the Data Act.

  3. You will receive the requested data in a structured CSV format via a secure link within 30 days of your verified request.

9. Sharing Your Data with Third Parties

You have the right to request that your data be made available to a third party (a "Data Recipient"). To do so, please follow the access process in Section 6. You are responsible for forwarding the exported data file to the designated third party. To protect Einride's trade secrets and intellectual property, Einride may require the Data Recipient to enter into a direct non-disclosure agreement before any data is shared.

Data Storage and Switching Information (Einride Saga Platform)

For users of the Einride Saga Platform, the following information is provided in accordance with Chapter VI of the Data Act:

  • Data Storage Location: User Content is stored on Google Cloud Platform (GCP) infrastructure in the European Union.

  • Data Export Format: User Content can be exported in CSV format, which is machine-readable and compatible with most data processing systems.

  • Switching Process: Upon termination, you may request export of your User Content by following the process in Section 8 above. Einride will provide access for data retrieval for thirty (30) days following termination, unless termination was for cause.

  • Switching Fees: No fees are charged for data export in connection with switching to an alternative service provider. 

  • Data Protection: Einride implements appropriate technical and organisational measures to protect data against unauthorised access, including encryption at rest and in transit, access controls, and contractual safeguards with our cloud infrastructure provider.

  • Migration Support: For technical support with data migration, including documentation of data schemas and field definitions, please contact data.act@einride.tech.
